mortgage divorce

I have been married about five years. During that time my husband has not been consistently employed, in fact much of the time he has not had a job. I supported his child (now 16) for the years we were together. I want to divorce and ask him to leave the house, he refuses. This was a result of my house being robbed while I was on vacation. My stepson is a suspect. I can't stand the thought of coming home to this house for many reasons. I am about 50,000 upside down on my mortgage. I am considering just walking away from it. Any thoughts or experiences would be appreciated.
I attempted to talk to my mortgage company about short sale. I was promptly told I am not eligible for anything because I am current with my payment. I asked what would happen if I just walked away, I was told "just do the best you can".
If i do a short sale while Bank of America pursue me for the difference?
