PAS? Maybe?

I've read a lot of PAS articles. One question. Usually it's the custodial parent subjecting the children... typically. What happens if it's one instance of the non-custodial parent pulling a PAS stunt? And I most certainly feel that's what he did by filing a frivilous protection order/battery charges against me a few years back. Is it that uncommon for a non custodial parent to make a PA attempt? And is there a statute of limitations on filing interference with custody charges? Thanks in advance.
