My wife and I are in the process of a divorce, I submitted a motion of exclusive occupancy since she was trying to hurt herself or whatever she was trying to do along with a police report (stayed at the hospital for psych. evaluation that day). The judge is now pending for additional psych. report from another place at the same time and he signed us a peace order while we can still reside at the marital place. (since I am unemployed and couldn't afford to live outside on my own)
She moved out 9 months ago to her parents' home and finally moved back under her attorneys' direction. She told her parents to move in and has been changing the house configurations. (guess some dirty tricks... although I am not too sure)... In her defense, she claims that she doesn't have other residences for her to stay but lied during the opposition of our motion about her moving out. (Her previous lawyer has sent a letter to my lawyer stating that she will move back few months ago and it was pointed out during the conference).
How likely will I be granted with exclusive occupancy under this circumstances? I am very uncomfortable with her movement in the house and her intention to bring her family members just to show that they also have no place to live.
Also would anyone knows what's the typical timeframe between pretrial conference to trial?
It has been a mental killing process and would like to know when would this be ended...
If you have any similar experiences or expertise, it would be appreciated to share.
Thanks
