Please help if you can .
I know this post is long and not very exiting, however it is practically matter of life or death for me, and I did not know how to do it better . I am including some answers from another forum, where I posted . I did it because I am having very limited access to the Internet, and wanted already everything to be said .
PLEASE ADVISE WHAT TO DO :
alimony taken by lawyer Lawyer is in New Mexico, I live abroad of US, case in New Mexico .
My ex sent two alimony checks to my lawyer . I got the letter from the lawyer, that one check is going to be deposited to my account, and second will be applied to my outstanding balance with his [censored] .
Does lawyer have rights to do it ?
thanks e *********************************************************** Are you late in paying your attorney?
Yes. I am . However, I paid him 20k over 3 years for an appeal, which he lost . My balance with him now is about 800 $, for additional motion, because my ex does not pay alimony . I intended to pay it in installments, when finally something is going to work, and I would receive alimony on regular basis .
e ********************************************************* If a check is made out to you, your attorney does NOT have the right to cash the check and keep the money.
Why is your ex delivering your alimony payments to your attorney in the first place? ********************************************************* Explanation .
I am divorced after 28 years of marriage, for 10 years now . 6 years after divorce, ex started and won the case about reduction of alimony . I appealed, I lost . I was not able to afford to live in US , I moved to another country .
Ex used to send checks to US address . I contacted the lawyer, to ask to file a motion, about bank deposit . He filed , judge signed .
I asked him, how much motion is going to cost, and I paid him this amount with credit card .
I was not aware, he asked in the motion for "direct deposit". Effect ; I was left without money for 6 months . I made a few phone calls to lawyer´s paralegal. Was informed :
first, I asked for direct deposit second, my ex tries to do it but bank rejects it
I provided all bank information.
I called the bank, the highest supervisor, assured me, not be able to make direct deposit, simply impossible . I suggested to paralegal, maybe amendment to to the motion, just deposit, without direct, would be in place .
After 6 months, letter from lawyer, he got a check for 6 months . He deposited money . Same month money for 7th month, appeared in my account as well .
Next month, no alimony . I sent email, no answer .
Next month , letter from lawyer, he got two checks , I am entitled to one only , and direct deposit is not working for " whatever reasons", according to the ex .
Friend of mine, opened mail for me, last bill from lawyer, 700 hundred something . Fees for his paralegal time on the phone, emails (2) to me, reading mine, and his time to contact opposite counsel .
I sent email, asking was check made to his name and why I own him so much, asking for current accounting via email, and yes I expressed my disappointment, that for so long time motion is not working .
I think, big mistake of mine, no answer and no any money in my account .
What should I do ? Please help . thanks
