once as a gift and says it was not
      10/27/10 01:36 PM

My husband and I have merried for 14 yrs and discussed about getting a divorce. We do not file anythig yet but soon. I am really desperate to find out some answers to my question. Before we got merried, my husband had a student loan and some loan used for his tuitions, paying bills which he spent for living cost with his ex-wife(yes, this is his second!).Soon after his first divorce, we met and lived together. Then he decided to buy a house but he could not get a enough loan for a house because of his student loan debt and his new car loan.He asked his father for money and he agreed to give him $50,000 as a gift, so he could pay off all debt and buy a house.A couple of month later, we merried and soon his father passed away. We found out that his mother had life insurance of his father under name of hers, my husband and his sister(her daughter). So my husband received some portion of money from father's life insurance and deposited into our joint account. It was almost 14 yrs ago and now his mother says it was my money and she wants it back.My Question is Do I have obligation to pay back to her although it was a gift from his father before we merried and also money from life insurance of his father? I never think money has nothing to do with my-soon-to-be-mother-in-law.I told my Husband that if he thinks she is entitled to get that money back and wants to pay back to her, you can pay her from your own money after divorce is final. Am I correct?
