Issues with the ex

Looking for some feedback:
My wife and I both are divorced and went through the "do it yourself" steps with both our exes to keep the courts out of it. While mine has progressed fairly well and my ex has worked alongside me for the best interest of my daughter, my wife's ex has been less than accommodating and refuses to help in making decisions and will not communicate.
She's considering putting her son in a private school and is trying all attempts to communicate with her ex, but he's not willing to address it. Her son has stated that he wants to go to that school as well, which is mostly due to the fact that my daughter goes there.
My question is, since the court was not involved in the divorce and left to the parents to make decisions regarding the child's well being (and especially since the child has indicated he wants the same thing his mom wants), can court intervention do anything at this point? Or can the mom move forward noting that it's in her child's best interest and that her child's indicated that this would make him happy?
Also on a side note, this would not cause a burden related to drive time or inconveniences of a similar nature...and I would be covering the costs of all tuition, so money wouldn't be the issue either.
