Can she do this?

My boyfriend currently has custody of his 5 month old son. The bm took off to Texas a month after he was born. Although she only stayed there for two weeks and then came back to our state(Maine). She is now staying with some friend of hers who convinced her to get a lawyer and fight for custody. We have had one court date already and she has sworn before the court that my bf is not the father of the baby and that she is willing to pay for a dna test. She said that my boyfriend was mentally abusive and thats why she went to Texas, that my bf actually paid for the ticket for her because she was a horrible mother. I did ask him if he paid for the ticket and he said yes because she wanted to go. Nothing was determined at that court date, but Im wondering the likely hood of her gaining custody.
