out of state 'vacation'

ok. does anyone know if there is a time limit on out of state vacations? my brother is recently divorced. his ex has sole custody, he gets visitation every other weekend. this is in oregon. she is moving to california with the kids. she says she is just going on vacation, therefore doesn't have to go through the courts, only has to notify the father. shes moving there for at LEAST a few months. his weekend for visit is this weekend, and she's leaving tomorrow. is there anything he can do?
