$$ issue before divorce

i am not sure this is the correct area for this question but i am wondering if i will get in trouble in any way once i do get divorced for this:
history:
married 25yrs, stay at home mom/homemaker entire time.
question: h is self-employeed. he deposits large sums of money into our household account but then transfers the majority of it to his personal account leaving household budget money. i need to pay a retainer fee and only have 1/3 of it saved up but life is getting more and more difficult to deal with with his outrages regarding my seeking a divorce. can i just use the money that he does leave in the account to help pay for the retainer fee or is that going to reflect really badly on me. i figure he is socking $$ into a personal account..isn't that basically the same if i were to withdraw money? :confused:
