Military Divorce and Retirement

My husband was previously married for 12 years, and his divorce states that he will pay a percentage of his retirement pay (50% times a fraction, the numerator is the number of month of marriage (139.17) divided by number of months of creditable military service. When he divorced, he was a 1st Class Petty Officer. Since our marriage he has advanced to Chief Petty Officer, and has recently been selected as Chief Warrant Officer. My question is, will his retirement benefits pay his former spouse at the paygrade of his divorce at 20 years credible service or will it calculate his most current rank at the time of his retirement at a possible 30 years? Divorce took place in California.
