My husband's ex is in dire straits financially (is basically living off the child support we pay and nothing else). She has had medical "issues" since before they were divorced and hasn't worked for about a year now because of back problems (before it was she had a hysterectomy, she had some kind of cancer, she had some kind of problem with her arm). She hasn't been responsible about her money at all. He paid a very large amount of alimony for the first five years so that she could go and finish the 2 years of college she needed for a degree, but she didn't do it.

Anyway, we just found out that she has moved herself and the 2 kids (15 and 17) into a friends house. She says it's just for a couple of months until she has another back surgery and can get a new place. We know she has no money. We give the kids extra money every time we see them to help.

But she absolutely refuses to give us custody of the kids. We have a big house, in which each kid has their own room (and has for years). We don't live in the same part of town, so part of the concern is that they'd have to change schools, but we're willing to help them stay in their current high school. They also have a grandmother with a big house and an aunt that do live in their area that they could stay with, instead of their current situation.

We're torn - do we file for custody? The older one will be able to do what he wants in less than a year. The younger one is her mom's pet child who doesn't want to leave her mom, but is in trouble with her schooling now - another reason why we want custody.

We're just not sure if it'll be worth fighting for months for such a short time. She so completely cannot provide for these kids. We do everything we can, but she goes around saying that we don't care, look at how poor they are!!!

My brother had a long battle and finally won custody of his daughter however it took years. He eventually got married to a police officer and she began helping him build his case like a good detective and quickly began making huge progress towards getting custody. The devil is in the detail and you have to be willing to track everything in a way that truly shows the children would be more successful in school and other areas of their life by living with you. If you want more detail let me know, the list in long and the fight to improve a child's life is worth it!
