Other side's atty has ignored all requests by my atty for financial documents (401(k), pension, etc.). Other side has not listed same on CIS.
At point where my atty has had to subpoena the records from the financial instituion. How can I go about getting other side to pay fees I incur as a result of the subpoena, etc. Is it worth it? common? and what are my chances of winning them? Or am I wasting time?

This is a New Jersey Case.

I can't predict what your judge will do, nor can I predict whether the other side will cave, but...

I would head straight to court and let the judge (mediator?) know first thing that the other side has not provided the required info, and that you are requesting reimbursement of legal fees that were incurred trying to get the financial info. OR you could ask the judge to impute whatever you think the amounts may be. A judge might just be mad enough to do so.

But really, your attorney is the one who has the best advice for you.

That is what I was thinking too.

Do I use the same docket # as my case or do I file a new complaint with the courts?

The divorce is being handled by my atty. But this I would like to pursue on my own since it is a simple matter.

I'm not a lawyer, and am certainly not well-versed in NJ law, but I'm of the impression that you cannot represent yourself while being represented by a lawyer.

You REALLY need to talk to your lawyer about all of this.
