Several months ago my husband asked me to sign a sep agreement. He said it was for tax reasons because we lived in diff states. IK. Dumb idea. But I trusted him. He promised not to do anything with it. If he still has a copy of it, can he surprise me somehow? He says nothings happening and marriage is OK.

The marriage is most definitely NOT okay and thinking it is, is somewhat shortsighted.

And yes, he can certainly file for a divorce if he chooses to and have the agreement as a basis for a divorce.

No such thing as having a tax issue because one person lives in another state. Either you file married, married filing separate return or single. If he's filing as married, will you get part of that return? Or being responsible for tax payments if it turns out that money is owed in taxes?
