Hey there. I have been married for 7 years, together for 13. My wife had a son before we met and I have been supporting them. I certainly make more money than my wife, and she will take full custody. We are in complete agreement about everything. If she does not request any child support, will there be any reason why i'd be forced to pay it?

I did not adopt the child.
The child calls me "dad" but knows i am not the biological father

Thanks.

Usually it is only the biological parent that is required to pay child support unless there are other circumstances that your state recognizes. One of those would be that you legally adopted her son. You shouldn't have to pay child support, but a lawyer might try to sneak it in to benefit your STBX wife. If your STBX will be receiving state aid then the state can require she tries to collect CS from the biological father. Is the biological father listed on the birth certificate?

Hey there Matilda. Thanks for the reply. Nobody is listed as the father on the certificate

You might need to take a paternity test to prove that you are not the biological father.

Nah, you're off the hook in this case. This child was not legally adopted by you. The only individual that will have to pay child support is his biological father. But, as another poster stated watch out for your ex's lawyer sneaking in child support in2 the agreement.
