Been married over 26 years, children are grown, assets are a house, and wife's military pension.

If I leave does it have any impact? Am I correct assuming it only applies to spousal support and children?

Thx

It depends on what state reside, as asset division varies greatly from state to state.

The only problem you might have is the house. I'll assume it was purchased during the marriage since you were married for 26 years. If either of you keep the home, they will owe the other 1/2 the value (minus mortgage or loans against the property, if any).

If your ex wants to keep the house after you leave, they can delay the process of you getting your share since there is no incentive to move things along once you have moved out.

Eventually however, you will get what is owed to you.
