How far can the state of Kansas go back to collect child support for the following. (In this case the state of Kansas wants monies paid back for temporary living assistance that the mother was on and the birth costs)
It's been over 10 years and now they start asking for it. Couldn't my hired lawyer throw that out? I never knew of the the child untill I got the court ordered child support forms in the mail. I'm being dammed for not knowing????? Isn't there a time limit for something like this on past dues for the state to collect??? The mother doesn't want to collect anything on past dues from eleven years ago.
Only this state wants past due monies collected. All the mother wants is up till now current (2004) child support.

I would perfer to pay now since I know now!!! =)

Ya can't blame them for wanting to get some of their money back.

Generally speaking, they shouldn't be able to go back any further than the date of filing, but some states allow as much as two years.

It's an interesting situation and the only thing I can recommend is that you get an attorney.

-Thank you! I'm using prepaid legal and getting an out of
state Family_Law Kansas attorney with a 25% discount for this case. I'll start getting on the ball and getting the paper work done. I shouldn't have to pay what the state
wants so far back like that. some of it yes, but 60% no!!!
Anyway, my lawyer should have all the answers.

As far as I know there is no statute of limitations on anything owed to the state for welfare. I could be wrong however.

Also, there can be a situation where the CP could have recieved aid before the court order for child support was even filed and that money is still owed. There doesn't necessarily have to be a court order for child support in order to recieve aid, especially if the person lies and says they don't know where they are. Eventually however, they do open up a case to recieve child support.
