Domestic Tort
- the allegation of wrongful act within a marriage that creates a liability for the defendant.
Application in Divorce
Some jurisdictions permit divorcing spouses to bring torts against their partners in divorce actions. These include assault and battery,
fraud
and interference with a person’s occupation. Today, domestic torts are uncommon.
In uncontested divorces, there are no domestic torts.
