Durable Power of Attorney
- an instrument granting another person legal authority to manage the financial affairs and make medical decisions for the principal who is unable to do so.
Application in Divorce
A durable
power of attorney
remains in effect in the event the principal becomes incapacitated. Sometimes called a health care proxy, it designates a surrogate to make medical decisions if and when the principal is incapacitated.
