Tenants with the Right to Survivorship (Joint)
- a form of ownership where each owner has the right of survivorship.
Application in Divorce
Called by one lawyer "a race to the grave," joint tenants with the
right of survivorship
means ownership passes to the survivors among the owners. For example, if John, David and Paul own a parcel of land as tenants with
right of survivorship
and Paul dies, Dave and John now own the land. Ownership does not pass to Paul’s heirs.
