New Hampshire Service of Process for Divorce
Process servers in New Hampshire are not licensed. Anyone over 18 who is not a party to the case may serve divorce papers.
In a New Hampshire divorce action, the divorce papers - the summons and the complaint - are personally served on the defendant by giving them to him or her or leaving them at his or her abode.
Divorce papers (with a fee of $10), may be served on the office of the Secretary of State.
Service on the Secretary of State has the same effect as if served on the defendant at his abode or place of business in the state or country where he resides. Copies of the divorce papers must also be sent by registered mail, postage prepaid, by the plaintiff or his attorney to the defendant at his last known abode or place of business. His or her return receipt and an affidavit of compliance, of the plaintiff or plaintiff’s attorney, becomes part of the record. When process is not delivered or accepted by the defendant, the court may order such additional notice, if any, “as justice may require.”
