I have a few questions about pension plans. A relative of mine was married in California, for about 25 years. They have been separated for about 5. He is in Arizona (has been for a few years now), she is still in California.
They are both community property states. She is still entitled to half his pension/retirement, correct? Even though they are divorcing in Arizona? He's tried to manipulate her, once again, saying that the portion of his pension that was "paid by the company" she is *not* entitled to. I think this is hogwash.
Any thoughts, advice?

"He" better get off his duff and quit dragging his heels about this divorce, because everything acquired during the course of marriage, and sometimes even stuff acquired prior to the marriage, may be divided any way a judge see's fit, in a community property state. Pensions too.
So to answer your question, I expect she would automatically be "entitled" to 1/2 of any pension(s) accrued during the course of their marriage...regardless of who contributed to the pension.
It's hogwash.
Experience is a wonderful thing. It enables you to recognize a mistake when you make it again.
