Hello, I'm hoping you can help or point us in the right direction.
My daughter (US citizen, living in Alabama) married a Filipino citizen in the Philippines. They have both agreed to end the marriage. He has never come here to the US. The problem is he refuses to sign the divorce papers. He insists on an annulment over there and says he needs $5000 for the annulment.
He says a divorce over here will not allow him to remarry but that's not true. There is a Filipino law in effect since 2005 (I believe) that will recognize a divorce from another country. We believe he's mostly looking to make money.
My daughter has contacted one attorney in Alabama and they said she is stuck if he won't sign. I asked about "substitute service" but the attorney said there is no substitute service method for an alien living outside of the US. I find this hard to believe.
Can you offer any help or advice?
