There is an interesting article in the case law reference:
A SHORT OVERVIEW OF NATIONWIDE CASE LAW ON
CLASSIFICATION OF THE MARITAL HOME
The reference section is pretty slim on a state by state basis for any given topic - such as the marital home.
My question is: Do courts/attorneys cite case law from other states when the underlying law is the same or similar between the two states? What can be inferred by looking at case law from another state? The above article seems to draw some inferences from similar state laws and their corresponding case law. Are the arguments made by this article useful in court?
Yes, of course the first answer is "it depends" but please any experience in this regard would be helpful.
