Document summary:
The trial court awarded the husband's $242,591.13 interest in a deferred compensation plan equally to the husband and the wife, but the court had a more difficult time with the issue of the husband's unused sick leave account, valued at $70,000. While the husband could not withdraw for cash the value of these funds, he did have this amount available to offset his $500 per month health insurance costs. The trial court noted that this created a disparity between the parties because the wife would have to pay $389.15 a month to cover her health insurance costs. The court determined that this amount less tax consequences should be divided equally between them.
